     TERMS OF USE

Shipping & Delivery 

At this time, iKey ships merchandise only to locations within the continental United States and not to international locations. Nor does iKey ship to Alaska, Hawaii, Puerto Rico, Guam or the US Virgin Islands. The risk of loss and title for all merchandise ordered on this Site pass to you when the merchandise is delivered to the shipping carrier.

Sales Tax 

Key charges sales tax for merchandise ordered on this Site based on the applicable state sales tax rate and the location to which the order is being shipped.

Warranties 

iKey warrants all keyboards and pointing devices against defects in workmanship or materials for (i) one year from the date of manufacture if purchased by an end user or (ii) ninety days from the date of manufacture for OEM models (collectively the “Limited Warranty”). If a product proves defective in either materials or workmanship, iKey will, at its sole discretion: (a) repair the product at no charge with new or refurbished replacement parts, (b) exchange the product for a new product or (c) refund the price of the product. The time period of the warranty for any repaired or replacement product will be for the balance of time remaining on the original product warranty.

Exclusions from Warranty Coverage

The following are not covered under the iKey Limited Warranty:

1. Damaged causes by abuse, misuse, or accident
2. Damage caused by use outside of specified ratings
3. Damage due to service by anyone who is not an authorized iKey service provider
4. Any product modified without the consent of iKey
5. Any product that has had the serial number defaced, modified or removed
6. Damage cause by connection to any other product
7. Damage arising from improper installation
8. Damage incurred during installation or removal
9. Normal wear and tear
10. Any other cause which does not relate to product defect
11. Any hardware upgrades after the date of purchase.

Warrant Disclaimer

THE FOREGOING WARRANTIES ARE IN LIEU OF ALL OTHER WARRANTIES, AND iKEY EXPRESSLY DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, PERFORMANCE, SUITABILITY OR NON-INFRINGEMENT AND ALL WARRANTIES THAT MAY ARISE OUT OF COURSE OF DEALING, COURSE OF PERFORMANCE OR USAGE OF TRADE.

Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall iKey or its suppliers be liable for any special, incidental, indirect or consequential damages whatsoever (including, without limitation, damages for loss of business profits, business interruption, loss of business information or any other pecuniary loss) arising out of the use, or inability to use, the products. iKey’s aggregate liability for any product or claim shall be limited to the REPAIR, REPLACEMENT OR REFUND OF THE amount paid for the SPECIFIC product that is the subject of a claim.
